Standard bank up for fraud


The following articles show that standard bank have a history of corrupt dealings,
The public has lost her rights, when banks start to defraud her. In the following article it is clear that the bank is willing to defraud their customers if the price is right. The question that I would like to ask is:



Why do they not lock the bankers up, why are they allowed to defraud their clients without any accountability?

The second article below show how standard bank employ lawyers with no ethical values.
How they take judgement against the very people that finance them without following the procedures required to do so.

If they can make decisions like this is it not possible that they will also decide before they sell you a insurance policy that they will never pay the benefits. Is it not possible that a great percentage of their premiums are collected without the intention to ever honour these contracts. Is this not fraud, against the very people that finance them. Perhaps it is time that I investigate the possibilities of insurance fraud against Standard Bank, perhaps it is time that people and companies stand up for their rights. We must remember that we are financing this fraud by using the facilities of the banks.
The real question that need to be investigated, Is Standard bank in any way connected to the obudsman?
We know that they will deny it, but will they ever acknowledge fraud, will they ever acknowledge their involvement in un-ethical behaviour, in possible corruption? No they will not, they will always wait and count on the fact that the client will not have the means to take action against them.
Perhaps we should ask them for finance so that we can take them to court, will they give this finance?
Probably not, and therefore they remain in control, they know that at the point where a client is dissatisfied they do not have the means for action. 

Standard Bank Up For Fraud.

To continue from our last email “Should SA ‘Banksters’ be put in Jail?“, we confirm from this press release that charges of civil fraud have been laid against Standard Bank (case number 34355/2012) in the Johannesburg High Court. NewERA is not party to this case, but we have a duty to keep our Members informed. The charges include:
- Five counts of misrepresentation
- Five counts of fraud
- Three breaches/contraventions of the Bank Act
In theory, all 19 million South Africans who have “credit” could make similar claims against their bank. This is primarily due to securitisation, a process that the banks are extremely secretive about.
This important case argues that a bank is not allowed to pretend that a customer is indebted to it. Banks send out regular statements of account. They collect monthly payments, they make claims for money and even threaten to take assets away on public auction. According to the evidence presented, all of this is illegal because the bank has secretly sold the debt to a third party, and in doing so loses its claim of right. In fact, the bank has already profited as a result of the securitised sale, and investors are protected by an insurance policy in case of a default.

NewERA shares the view that banks must disclose to the customer that their loan or credit card has been settled by a third party because it impacts their legal standing.
While this is a civil fraud case, the Ubuntu political party is investigating a case of criminal fraud as well. More than 200 people have already indicated that they would join the proposed criminal charges against their bank.  Standard Bank At it Again and the Constitutional Court has made a ruling against them ( See Article Below )
Standard bank were professionals in obtaining Judgements against their Clients in the 1980. They are at it again.
This was the most dishonest corrupt and unethical  lawyer ever to practice in South Africa. His major client was Standard Bank, Standard Merchant bank and FNB Bank.

The said three banks knew he was unethical and dishonest, but used him because he could get a judgement against one of their clients without delivering a summons.
He had it all worked out with the two Banks. He would issue a summons and have it stamped at the Supreme or Magistrates Court. He would then pay of the Messenger of the court or the Sheriff to give him a return of service with Delivering a Summons. Armed with this he would obtain a judgement and deliver the final order to the person concerned.
Hundreds of judgements were obtained in this way with the full knowledge of the Standard Bank and First National Bank,
We can only thank God that the Pretoria High Court Judges Eberhardt Bertelsmann and William de Villiers found him to be danger to Society and an Embarrassment to his Profession and had him struck off the roll.

Standard bank has challenged me on twitter, by telling me that they have concluded talking to me and that I can do nothing about it, so if you have any information on any unethical behaviour please contact me.

Why do I attack Standard Bank

The question that bothered us the most in the refusal to pay a claim was the fact that the insurance document excludes Standard Bank for any liability on any construction site. During the application for insurance the document application form required type of business, in this box we filled “Construction Company” in.

The bank assistant handling the application was not an insurance expert, and advised us that Standard Bank insurance will contact us to explain the insurance in detail; she also told us that Standard Bank will send us a policy document shortly. None of the above ever occurred, and we stayed under the impression that our premiums covered us as a construction company.

We had an incident on one of our sites, and only after we claimed they informed us that we are not covered for construction work. They also claimed that they did call us to explain the terms and conditions of the document. When I asked if all these calls are recorded they reply yes, and I asked them to allow me to listen to the recording. After a few days I received a personal “twitter” message telling me that I need a court order to listen to the recording.

In my view I have the right to investigate and therefore have the right to listen to the recording, after all if the recording exists where they explained to me that my construction company is not covered for construction, it will clear the case and I would have to accept the responsibility for the failure of the claim. I do not understand why I need a court order to listen to the conversation that allowed them to deduct premiums in conclusion of the contract. According to me it is my basic right to examine the alleged call.

At the moment I believe that this recording does not exist, I believe that they did not do their work correctly and now hide behind court orders.

The bank then referred me to the Ombudsman, which is clearly a tactic to delay their responsibilities to comply with my requests.

The time has come to warn other companies and people of the shady techniques of Standard Bank, and therefore I started a blog to expose it.

If Standard Bank sends me the alleged recording and it clear them from any wrong doing I will publically apologies for the media attack against them. But up to that point I will keep on alleging that they have committed insurance fraud, contract break and incompetent management. Their lack of service to resolve this issue is shocking.

First OPEN LETTER TO Mr Ben Kruger, CEO STANDARD BANK




RE: SHOCKING CUSTOMER SERVICE AND UNPROFESIONAL FINANCIAL ADVICE FROM STANDARD BANK INSURANCE DIVISION.


Dear Mr Kruger.


I have been a loyal customer of Standard bank for approximately 20 years, opening my first Standard bank account at Florida branch Gauteng. I have always believe that I could take sound financial advice from the bank, and therefore five years ago I opened three business accounts with standard bank Amanzimtoti, I used all facilities available to business and whenever I was in doubt contacted my standard bank business consultant.

I did the same a few months ago to apply for vehicle finance, (not the first business vehicle with Standard Bank); after the business consultant completed my application she showed me a business insurance deal available. I was immediately interested in the public liability cover, as it is of cardinal importance for a construction business to be covered. After looking at the liability cover I instructed the consultant to apply for the insurance on my behalf. I chose the cover that had sufficient liability cover for the company. We proceed filling the form in and stated under type of business “Construction”. The business consultant could not tell me much about the insurance as she is not an insurance specialist, but assured me that, I will receive a call and a policy document soon. She advised me to ask all my questions to them when they call me. She further told me that if the insurance is not to my satisfaction Standard Bank insurance will sort it out for me. I was satisfied with the service from the branch and understood that the consultant are not an insurance expert.

Unfortunately early this month we had a huge incident on one of our sites when, a retaining wall collapsed and damage our customers boundary walls. Due to the fact that I did not receive any correspondence or telephone calls from Standard Bank insurance yet, I visited my business consultant who like always assisted me immediately with a claim form.  A week later I was informed that my liability was not for construction work, so a Construction company was insured for everything excluding construction. I lodged a complaint and asked that they send a professional out to the site to at least look at the damage and advice to what fall within and what fall out of the parameters of the policy, Standard Bank refuse to send anyone to the site to assist. I lodged a complaint with Mr Mpo Maimane, He advised me that the insurance was within their rights to reject the claim and that if I have any problem with that I should contact the ombudsman.

Please understand I have no problem with the point of sale procedures, I have a huge problem with the exclusions that I see for the first time after I lodged a claim, I have a problem that Standard Bank insurance can allow a policy to be captured from a construction company with exclusions for construction without contacting me to explain it. I furthermore have a problem with the management conduct not answering any of our questions or any professional assistance when we ran into a problem. My wife is with First National Bank and all her insurance is through the bank, whenever she embarked on cover FNB insurance called her explaining the policy and exclusions, they also send a document via e mail and then post a hard copy of the documentation, they do not take any premiums before they had spoken to her. Standard Bank however took premiums immediately, with no telephonic conformation and or explanations. Mr Maimane gave me the date that my policy document was posted, but to date I have not received it.

I Apologies that I had to write an open letter but the bank refused to give an email address.

The real questions I would like to ask you Mr Kruger is...

Do Standard bank only value us as customers while we pay bank charges and fees? Do we only became  a burden when we ask for advice or if we lodge complaints or are we just too small to be worth the time and service, do the bank turn a blind eye if they destroy small business, when employees must be laid down due to the so called miss-understandings between the bank and the customer. Is our contribution to help built the South African economy not worth the time of mighty Banks and corporations? Where was the Bank when we asked for assistance for financial advice for service? I hope Mr Kruger that this is not the case, that the weak service was only due to a unqualified or ignorant bank complaint clerk and Mr Kruger that this is not the view of management, that it is not the blue-print that the bank use to ignore small business. Mr Kruger I will understand if you rule to safe the Bank insurance, I will understand if you decide that you Mr Kruger do not have the time to read this letter, I will understand if you decide that we are too small and that we do not deserve the banks time never the less you esteem time. I just hope that other businesses will not have to walk the same way, that you Mr Kruger will ensure that not more small companies and thousands of workers will lose their jobs due to exclusions and the lack of service from some employees that sit in their air conditioned offices while we the small business try to build a better South Africa for all. Mr Kruger you will probably think who gave this man the right to write to me, I must tell you Mr Kruger it was not one of your employees, Mr Kruger they all kept their word to keep you in the dark, to tell you about their good service that they provide for customers. So Mr Kruger please do not handle them like they handled us, please help them

Dear Mr Kruger

I have now exhausted all avenues to discuss matters with your Bank in an effort to settle the matter in a civil matter. Once again Mr Kruger you esteem bank managers and clerks have blocked me from information needed to evaluate the case.

Yes Mr Kruger I am still talking about the case where Standard Bank insured a construction company, with exclusions of construction. Still the same claim, that Standard Bank insurance refuse to accommodate or take any responsibility for, where the lack of service from Standard Bank has caused the escalation of the problem.

Mr Kruger I am still alleging that incompetent management and the lack of essential service has caused huge damages to me, one of your clients Mr Kruger. The same case Mr Kruger where the lack of control from you insurance department caused innocent workers to lose their jobs. I know this does not rate as a problem at Standard Bank as these workers would never have made money for you Mr 

Kruger, they would never have the ability to finance vehicles, overdrafts and other bank services that create income for Standard Bank. Yes Mr Kruger we all know that these people and the upliftment of their communities does not matter to Standard Bank, it does not matter that if poor people in South Africa cannot eat due the a huge error of a air-conditioned dweller in an office. As long as the lack of service does not influence the bank clerks  salary, as long as they do not need to go hungry for a day.

These managers claimed that they did phone me to explain the insurance, so I asked them to send me the recording of the call where they discussed the new contract with me. I was then told that I need a court order to listen to the alleged tape, yes Mr Kruger the one with my voice on, the one that give them the right to deduct the premiums from my bank account. Yes Mr Kruger I need a court order to listen to that tape. You probably asking why this small business owner would want to listen to a contract tape, it is a valid question. Let me explain to you Mr Kruger, if that recording exists I will take full responsibility for the failure of the claim. You see Mr Kruger I have been brought up in an Afrikaner home, where we take full accountability and responsibility for all our actions. I am aware that these values of accountability do not exist any longer in our country, and yes Mr Kruger I apologies if I insisted on basic values that Standard Bank does not uphold. I apologies if my call of duty was above the code of conduct of Standard Bank.

Once again when you tell the people to resolve a matter and get rid of unwanted publications, be careful, you know the story where the general tell the brigadier and so it went down the line to the troop who had nobody to blame so he kicked the dog (the client in your situation). Remember that this client will not get kicked without retaliation.

Your worker did refer me to the ombudsman Mr Kruger, but as we all know this process take months to resolve, months that we do not have. However Mr Kruger if Standard Bank do not have the means to pay the insurance out at this point, please make an arrangement, don’t refer me a time stalling system.

Yes Mr Kruger the only thing this unimportant client want from the bank is the right to listen to the alleged recording, to conclusion of the contract. If the recording explain to me that this insurance policy exclude me the construction company from construction, then I am responsible for the problem, then I am the man who caused innocent workers to lose their jobs.
So Mr Kruger can you please tell you esteem managers to send me a copy of the recording
